1 Scope and responsible business
New Wave Harbor LLC explains in this Privacy Policy how it handles personal information through its websites, applications, marketplace, booking and payment functions, operator tools, support, and white label services that link to this Policy. Personal information means information that identifies, relates to, or can reasonably be linked to an individual. This Policy is a notice about our practices; it is not a blanket consent to optional processing.
For our own accounts, marketplace operations, payment administration, security, and legal compliance, New Wave Harbor LLC determines the relevant purposes of processing. For some white label operations, we process information solely on an Operator’s instructions under our agreement with it. Our role depends on the actual activity, not the logo displayed on a page.
An independent marina or Operator may separately determine how it uses renter information for its rentals, safety requirements, records, and customer relationships. Its privacy notice applies to those activities. The booking experience should identify that Operator and provide both notices. If you are unsure which business handles your request, contact us and identify the marina or booking channel.
2 Information we collect and where it comes from
Account and contact information. We collect information you provide to register, update a profile, or contact us, such as your name, email, phone number, address, date of birth where requested, profile image, account credentials, and communication choices. We receive verification results and account-security information generated during account use.
Booking and transaction information. We receive searches and booking details, selected vessel and Operator, departure location, dates, passenger count, requested extras, booking messages, receipts, payment status, cancellations, refunds, and dispute records. Where a rental or safety process requires it, information may include renter qualifications, signed agreements, emergency-contact details, and information needed to assess an incident or claim. Provide another person’s information only when authorized and necessary, and inform that person of its use.
Payment and Operator information. Payment providers collect payment credentials and verification information needed to process a transaction. In card-entry features powered by Stripe, Stripe processes the submitted card details, and we receive the payment token or reference and relevant transaction information. Operator onboarding and payouts may involve business contacts, proof of authority, tax or payout details, and account-verification results. The information received by us depends on the payment and onboarding service used. Do not submit card security codes or full payment credentials through support.
Communications and content. We collect messages, support requests, reviews, listing content, uploaded documents or images, and information you choose to enter into available chat or AI-assisted features. These submissions may contain personal information. Do not include sensitive information that is unnecessary for the request. Public reviews and listing information can be seen and copied by others. We publish marina and boat listing details supplied for display, including the marina or business name and an owner or representative’s name where provided as part of the public listing. Operators should supply only information they are authorized to publish. A public listing does not make renters’ account details, private booking messages, or payment credentials public.
Device and usage information. Our systems and service providers collect information such as IP address, browser and device type, operating system, pages or functions used, timestamps, referring pages, error and security logs, session identifiers, and cookie or similar storage information. IP addresses and activity records may identify or relate to a person; they are not automatically anonymous.
Location information. We use locations you enter, such as a departure point or search area, and may infer an approximate area from an IP address. If you grant the browser or app permission to use your device location, we process that location for the requested nearby-search or other disclosed feature. You can withdraw device permission in your settings. A marina may operate separate vessel tracking or onboard recording; it must disclose that practice. This Policy does not authorize undisclosed audio, video, biometric, or continuous vessel tracking by New Wave Harbor LLC.
Information from others. Operators, payment and communication providers, authorized account users, and people involved in a booking may supply confirmations, contact updates, incident information, delivery results, or fraud and dispute information. If a third-party sign-in is offered and you choose it, we receive the account information permitted by that sign-in provider and your settings. Additional sensitive verification or background checks require an appropriate separate notice and any legally required consent.
3 How we use information
We use information to establish and secure accounts; verify contact methods and applicable eligibility; find and arrange bookings; deliver white label tools; process payments, payouts, refunds, and disputes; and communicate about your requested service. We also use relevant information to support customers and Operators, investigate incidents, detect misuse, maintain and improve service performance, keep business records, and satisfy legal obligations.
We use optional information for the purpose explained when it is requested. Marketing, advertising, sensitive-data processing, or a materially different use is subject to the disclosures, choices, and consent requirements that apply to that activity. Booking with an Operator does not automatically consent you to unrelated marketing by that Operator or by New Wave Harbor LLC.
If AI assistance is available and you use it, your inputs and relevant conversation context may be processed by the providers used to deliver that feature. We must disclose any materially different use before it occurs and obtain consent where required. Automated suggestions do not make a booking or determine insurance coverage. Contact support if you need a person to review a significant account, booking, or fraud-related decision; statutory rights to contest automated decisions apply where the law provides them.
4 When information is disclosed
Operators and booking participants. We provide the relevant Operator with information reasonably needed to respond to a request, deliver the booking, verify eligibility, meet safety or record duties, and address a claim. This can include renter contact details, booking information, relevant qualification records, and communications. Renters receive the Operator’s relevant contact and trip information. Other guests receive information only as needed for an authorized purpose. Operators do not receive your account password or full card credentials from us as part of ordinary booking coordination.
Providers working for us. We disclose information needed by hosting, storage, security, payment, communications, support, mapping, and other contracted providers to perform their services. Stripe powers the relevant card-entry functionality, and Amazon Web Services and telecommunications providers support the SMS verification service when enabled. Provider access must be limited to the agreed purpose and subject to appropriate protections. Some providers, such as payment processors, also have independent legal responsibilities and their own privacy notices.
White label service relationships. An Operator receives and manages its own customer and booking information through its branded tools. Where we act on its instructions, access and processing are governed by our service and data-processing agreements. We do not treat an Operator’s customer list as permission to share those customers with unrelated Operators. When we separately process information for our own account, payment, security, or legal purposes, this Policy applies to that processing.
Safety, claims, and legal requirements. Relevant information may be disclosed to emergency responders, insurers or claims administrators actually involved in a matter, professional advisers, regulators, or law enforcement where needed for a lawful request, legal obligation, safety response, investigation, or establishment or defense of a claim. Disclosures should be limited to what is appropriate to the purpose; a general possibility of a claim does not authorize unlimited disclosure.
Business changes and your directions. Information may be transferred in a merger, financing, reorganization, sale, or similar business transaction, subject to appropriate protections and applicable law. We may also disclose information when you direct us to do so or provide a specific consent. A change in ownership does not by itself authorize a materially incompatible use without the notices and permissions required by law.
5 Cookies and similar technologies
We use cookies or similar browser and app storage to maintain sessions, support sign-in, remember relevant preferences, and protect booking and payment functions. Providers embedded in a page may also receive device and usage information. A white label Operator may place its own technologies on a surrounding website; the Operator must explain and control those technologies under its own notice.
You can manage cookies through your browser and device settings. Blocking necessary storage may prevent sign-in, checkout, or other requested functions. Optional analytics or advertising technologies, where used, must be identified with their purposes and applicable controls in the published cookie notice. Required consent must be obtained before those technologies operate. A browser setting alone does not replace a legally required consent or opt-out mechanism.
We do not currently use advertising pixels or optional analytics trackers on this website. Our Cookie Policy explains the website’s necessary storage and embedded services. If we introduce optional analytics or advertising technologies, we will update the notice and provide the choices and consent controls required before their use.
6 Sale sharing and targeted advertising
We do not currently sell personal information, share personal information with advertising partners for cross-context behavioral advertising, or use personal information for targeted advertising. Disclosures needed to operate bookings and other requested services are explained in Section 4. If our practices change, we will update this Policy and provide any legally required notices, opt-out methods, and consent controls before the new processing begins.
We do not sell SMS opt-in data or consent records, or share them with third parties for their own marketing or promotional purposes. We disclose SMS information only as needed to operate the verification program, provide support, protect against abuse, or meet legal obligations. General business-transfer and provider language in this Policy does not permit use of SMS consent records for third-party marketing.
Where applicable law requires it, we obtain prior consent before selling sensitive personal data and provide the specific required notice. Where a sale, sharing, targeted-advertising, or sensitive-data limitation right applies, you may exercise it through the published privacy controls or contact us. We must recognize legally required opt-out preference signals, including Global Privacy Control where applicable. Legacy browser “Do Not Track” settings and legally recognized opt-out signals are different; this Policy does not excuse failure to honor a required signal.
7 Email texts and communication preferences
New Wave Harbor LLC may use your email address and relevant marketplace preferences or booking activity to send its own boat-booking offers, promotions, and marketplace updates, where permitted by law and with consent where required. Promotional emails will identify the sender and include an unsubscribe method. You can also ask support@newwaveharbor.com to stop marketing emails. We will honor opt-out requests within the applicable legal timeframe. Opting out of marketing does not stop necessary account-security, booking, payment, or other requested service messages.
For existing or prospective Operators, we may also send feature announcements, product updates, onboarding invitations, or offers to join or use our Services. We use relevant business contact details provided to us or lawfully obtained for that purpose, where permitted by law and with consent where required. Promotional operator emails include an unsubscribe method. Essential security, billing, contractual, or service-change notices may still be sent when necessary for an existing relationship.
We do not give unrelated advertisers permission to market to you merely because you have an account or booking. An independent marina’s marketing is subject to its own notice and the permissions required for that activity. Permission for our marketplace offers does not automatically cover an operator’s separate campaigns or promotional SMS.
Account and booking messages concern the service you requested. Email is used for login and password recovery. You may unsubscribe from marketing emails using their unsubscribe control or contact us; necessary service messages may still be sent. Optional marketing is subject to applicable consent and opt-out requirements. An Operator’s independent marketing preferences may need to be managed with that Operator.
When SMS profile verification is enabled, we process the submitted phone number, consent and opt-out records, verification status, requested-code events, and delivery or failure information. We provide the information needed to Amazon Web Services and telecommunications providers to deliver the requested message and prevent abuse. This verification program does not send promotional messages.
Reply STOP to stop texts or HELP for help, or contact support@newwaveharbor.com. Message and data rates may apply. We retain sufficient suppression information to respect opt-outs. Turning off SMS can affect verification while it is required, but it does not authorize marketing or remove your privacy rights. Phone verification confirms access to a phone number, not a person’s identity or trustworthiness.
8 Retention and deletion
We keep personal information for as long as reasonably needed for the disclosed purpose and applicable obligations. Factors include whether an account or booking is active; tax, accounting, safety, and contractual requirements; payment disputes and legal claims; fraud prevention; and the need to honor privacy and communication choices. We do not retain every category indefinitely merely because an account once existed.
Booking, payment, and signed rental records may need to be retained after account closure. For Florida livery records, applicable rules generally require the Operator to retain written rental agreements for at least one year and signed instruction statements for at least 90 days; a longer period may be justified by another legal duty or claim. Where we store these records for an Operator, its lawful instructions and our agreement also govern retention.
Verification codes are short-lived; verification, consent, and suppression records may need longer retention for security and compliance. When information is no longer needed, we delete it or make it appropriately deidentified, subject to lawful holds and backup cycles. Retained backups should remain protected and limited in use. Account closure does not automatically delete an Operator’s independently held records or a public copy made by someone else.
9 Security and incidents
We use reasonable administrative, technical, and organizational safeguards appropriate to the information and processing involved. No internet or storage system is completely secure. This statement does not waive our legal duties or make you responsible for a failure to use required safeguards. Use a strong password, protect codes, and promptly report suspected account misuse.
If an incident triggers a notification obligation, we will notify affected individuals, authorities, and business customers as applicable within the required time and manner. A generic service announcement does not replace legally required breach notice. Where an Operator is responsible for the affected records, we will cooperate with it under applicable law and our agreement.
10 Your choices and privacy requests
You may request access to, correction of, or deletion of personal information or closure of an account by emailing support@newwaveharbor.com or writing to the address in Section 14. Identify the account or booking and the nature of the request. Do not send a password, full payment details, or an identification-document copy unless we provide an appropriate secure method and explain why it is necessary.
Depending on where you live, the law’s applicability, and any permitted exceptions, rights may include confirmation of processing, access and a portable copy, correction, deletion, withdrawal of consent, limits on sensitive-data use, and opting out of sale, sharing, targeted advertising, or certain profiling. You may have a right to use an authorized agent or appeal a denial. We will honor rights that apply and will not unlawfully discriminate against you for exercising them.
We may verify your identity and an agent’s authority using information proportionate to the request. We respond within the applicable statutory period and explain a lawful denial or extension. You may ask for review by replying to our response with “Privacy appeal” or contacting the same address. Where available, you may complain to your state attorney general or another competent privacy authority. Contacting us does not waive that right.
Where we hold information only for an Operator, we may direct the request to that Operator and assist it as required. We handle our own separately controlled information ourselves. Deletion and access may be restricted by legal retention, another person’s privacy, fraud prevention, or an active claim; we will explain the relevant exception where required. Withdrawing consent does not invalidate prior lawful processing and may affect a feature that depends on it.
11 Children and passenger information
Accounts and bookings through the Services are for adults aged 18 or older. The Services are not directed to children under 13, and we do not knowingly collect personal information directly from a child under 13 without the measures required by applicable law. If we learn of such collection, we will investigate and delete or otherwise handle the information as the law requires.
An adult may need to provide limited information about a minor passenger for capacity, age-specific safety rules, or a required rental record. This does not create an account for the child. The adult must have appropriate authority, and the Operator and New Wave Harbor LLC must limit use to the lawful disclosed purpose. A parent or guardian may contact us about a child’s information. An adult-use statement does not remove obligations that arise from actual knowledge of underage use.
12 International access and processing
New Wave Harbor LLC is based in the United States. Information may be processed in the United States and other locations where authorized personnel and providers operate. Applicable protections can differ by location. Where a law requires a transfer safeguard or additional notice, we must put it in place; merely using the Services is not treated as consent that replaces a required legal safeguard.
If a non-US privacy law applies to the relevant processing, we will honor the rights and requirements it imposes. Additional regional disclosures, legal bases, representatives, or transfer information may be necessary for services deliberately offered in that region. Contact us with questions about the processing relevant to your account or booking.
13 Updates and external services
We may update this Policy as practices or laws change. We will show the updated date and provide appropriate notice of material changes. New uses requiring consent will not be authorized simply by posting a revision or by your continued use. The Policy should remain accessible before information is collected.
Links, external payment services, Operator websites, and other independently operated services may have their own notices. Review them when using those services. This Policy describes New Wave Harbor LLC’s activities and does not make an independent third party exempt from its own privacy obligations.
